You can try, don't think you have a leg to stand on. They have always had a fair usage policy as far as I can remember (I signed up in 1997). This is there lastest one.

There is a clause in your contract that they can change policy with fair notice, I think the traffic management was announced 30 days before it happened. Not sure but you possibly could have cancelled in that 30 day period.

Also if you sign up over the phone I believe you have 14 days to cancel (though you might still get charged installation charges if they have installed during that period) due to distant selling act.
