toshela c50-a-146 wipe hardrive windows 8

Hi my son has wipe the hole hard drive on his toshela c50-a-146 lost all the partitions it came with window 8 how do i go about getting legal copy windows 8 and using the bios key what i can not see.

Found a clean copy of window 8.1 will this work with oem key that inbeded in the bios he update to windows 8.1 before he wipe it thank you for the help
