Can the 3GS I phone be updated using the latest I tunes ? vers 9 ? or can anyone advise the best version to use ? I have just tried with latest and it checks the phone and fails ? any help / advice appreciated : )

Pretty sure that is your iphone not itunes, the new 3GS reports the ECID to Apple via itunes and if it is jailbroken it reports back as false and fails.

You need to read up on Sauriks ECID server on how to get around it, at the moment jailbreaking a 3GS seems a right pain in the ass and i f you did not get the ECID file before to JB the first time you could be fecked.
