A court commissioner has issued a warrant for the arrest of Courtney Love on her 40th birthday after the rocker-actress failed to appear for her arraignment on a felony assault charge.

The performer's attorney told the court on Friday that Love was in New York and confused about whether her presence was required in the California case.

Los Angeles Superior Court Commissioner Dennis Mulcahy waited nearly three hours for Love to show up for the hearing before issuing the bench warrant.

The charge of assault with a deadly weapons stems from an altercation with another woman at the Los Angeles home of her ex-boyfriend and onetime manager, Jim Barber, in April.

In May, Love pleaded guilty in an unrelated case to being under the influence of cocaine when she was arrested outside Barber's home last October by police who said she was breaking windows in the middle of the night.

The former singer for the band Hole faces separate drug possession charges in Beverly Hills and a reckless endangerment charge in New York City.

A judge in the New York case came close to issuing a warrant for her arrest when Love showed up five hours late for a court hearing last month. A California judge issued an arrest warrant for Love in February after she skipped proceedings in two criminal cases, but that warrant was withdrawn when the singer made it to a later hearing.
