gears of war update

i flashed a m8's 360 for him and got him online, but when he puts gow in and it asks him to update it cant do it and asks him to check his connection. i have tried all my other games on his system and they all update no problem. the gears of war disc is an origional and the rest were mostly rips.
any ideas lads as i have heard of this problem before but dont know what to do..
