A SCHOOL caretaker who has used ladders for 30 years is suing after he fell off one – saying he was not trained to use it.

Anthony Gower-Smith, 73, wants £50,000 compensation for injuries.

He said he put the 6ft ladder side-on to the wall instead of at right angles, making it unstable.

Mr Gower-Smith toppled off as he removed a card display and staples from a wall at the school gym.

He fractured his skull, broke a cheekbone, split a kidney and spent time in intensive care, the court heard.

The caretaker said he had been told not to stand on the top step or work more than 10ft above the ground – but given no other advice on using stepladders.

The pensioner admitted ticking a box to say he was given safety training when he took the job in 2002.

But he added: “When you are given something to sign by your superior you just sign it.”

At first he blamed himself for the fall and told police he had been standing on the top step, the court heard.

But he said: “I don’t remember what I said – I was dazed.

“But I wasn’t on the top step because I had no need to be.”

Mr Gower-Smith was asked by the judge whether he had a stepladder at home, and admitted he had.
He also used a ladder for 30 years when he owned a petrol station, Winchester County Court heard.
Defendant Hampshire County Council said in a statement: “The claimant knew perfectly well how to use a stepladder.”
Married Mr Gower-Smith, of North Baddesley, no longer works at Awbridge Primary School near Romsey.
Judgment on the case is expected this week.
 
This really makes me sick. These "No Win-No Fee" chancers are making a mockery of the legal system. I hope the judge uses common-sense and sends him packing with sweet fa.
 
its just common sense stuff this, he'll want to sue gravity for his ladders falling eejit

There are genuine people out there thats been hurt through down right negligence and these people are not getting fair compensation because of cases like this.

Anyway, apparently on his employment form he ticked that he was experienced with ladders.

He would have placed it parralel to the wall rather than face on.

It would have been a lot less stable if he was working on something at right angles to him.

The working at height regulations came into force in 2005.
He shouldn't have been using steps unless they were the only method os access possible.
You can then only work on them for 20 minutes!!
He should have used scaffolding or a platform with handrails round it.
It sounds over the top but it's law!

Its sad but true that if you employ someone and do not train and retrain on a regular basis and document it and something happens then you end up pulling the old cheque book out.

I had a HGV driver that had been doing the job for nearly 30 years, he pulled an airline off the head of a trailer improperly and the heavy metal union flew back and smashed his teeth.


Guess who picked up the tab for that.............

Well i think the guy is right. An employer has a duty of care to its employees.
Why the fook did they let a seventy year old go up a ladder. A duty of care is not just seeing him tick a box. Did they carry out a risk assesment or train him on risk assesment.
 
You can't blame a person from playing the system.

It's just makes my blood boil that these numpties get paid out more than soldiers coming back home
with horrendous injuries
 
People blame the government for the state of this country but its not just them its people like of this as well makes you sick sometimes its all about money :( .

Would have to agree with the sentiment regarding greed.

We get the government we deserve, and the majority of people will always try and cheat (play) the system and use the 'everyone does it' excuse.

I am as bad, unfortunately. I pirate mp3s, games, tv etcetera (for personal use).

However, I never will file frivolous law suits/claims aginst people/companies/government as thats a step to far. For example, I have been in two cars crashes as a passenger, and never claimed once.

Perhaps I should wear a white suit, but dirty the collar because of all the porn I watch?
