some legal advice?

Hi all

I would like some help with a problem I am having with company that I purchased some new car parts from eBay.

My cars clutch and dual mass flywheel went which meant a costly repair from Vauxhall or I buy the parts of eBay and go to a local garage. I decided to go for local garage, so I bought the parts from a company of eBay called techniclutch. I ordered a sachs kit but was later told the clutch was unbranded which he does not state in the ad, I ordered on the 31st December and did not receive them until the 7th January. I had the car taken by pickup carrier to the garage on the 12th January.


After having the set fitted I noticed a problem with pulling off in 1st and reverse gear giving me a judder like it was going to stall and difficulty going through the 2 gears. I returned to the garage and they checked for air pockets and gear oil level but it was fine I thought it might need wearing in as the supplier informed me over the phone. On the 28th January there was burning coming through and I decided to go back to the garage and was told I would have to have it stripped again, once the sub frame was removed there was a lot of leeway in the dual mass flywheel causing the judder and gear selection problem, they informed me they need to change the full kit.


I contacted the company and let the garage owner inform them of the problem they refused to believe it was the dual mass flywheel and said it was a faulty clutch and they would send out a replacement the next day and to pack the one on the car to return. They ignored the mechanic who had been doing this for 25 years. I had to pay £220 for 5 hour labour cost to remove the set.


Well the following day it arrived and the garage installed it, again the same problem which clearly pointed to the dual mass flywheel. My mechanic again phoned them for me saying they ignored his opinion and decided to go for an unbranded clutch again instead of the whole kit. I later got a call saying as I bought it through eBay so the rest of this dispute will have to go through them. They now want it all returned for them to test it.


I will now have to pay another £220 to have it removed and £25 to post it to them as they refuse to pay for postage. They informed me I cannot claim labour costs of them which I believe is wrong.

They are advertising new parts yet other customers are experiencing problems and stating their parts are reconditioned or used.


I am not sure where I stand legally about claiming my money back for the labour costs and there false advertising on new goods which clearly are defective.

Tricky one that, firstly, your main problem will be trying to find out who's actually to blame. You say the garage said the parts were at fault?, I very much doubt the garage would own up it the part/s were incorrectly fitted and now there is no way of knowing as they took it out. I would have took it elsewhere to let some else give an independent view on whether it was the fitting or the parts that were at fault. 25 years or no 25 years some garages still get it wrong, inexperienced young lads working for them , rushing jobs, etc.....

As for the company you bought from ? 7 bad feedbacks and 4700 positives in the past 12 months is pretty darn good for eBay. You will have your work cutout with this one proving who's at fault , they'll both no doubt blame each other. I had a similar problem buying parts in then getting a garage to fit them, never again. If you let the garage buy in (I know it's dearer) and the repair is not right then you at least have a leg to stand on.

Thanks for the replies, trading standards emailed me back saying it all goes through citizen’s advice now and they can refer this to trading standards.

I know it is great feedback but again any negative needs to be negative for a reason. Out of 22000 items sold you only see 4000. I have never had problems with the garage that I have used for over 10 years on all my cars and he is also a friend. Their advertising is not great as well as I can fool people into thinking the full kit is sachs brand from the picture
 
sorry to say mate but this needs put down to leason of life IMHO . why would a garage that you been dealing with for 10 years and a so called friend not get the parts from there supplier
least that way parts can be returned. cheap ebay parts are more trouble that there worth sometimes (learned this a few times )
you may get your money back from ebay but just file a claim and see . the seller will blame the fitter and fitter blame the parts
either way your out of pocket and should have got a dealer to do it . clutch and timing belts are the only jobs i would recommend dealers for
as there usually only a couple of hundered in it and least with main Stealer you have a little more cover

My thoughts exactly, if anything goes t*ts up both will blame each other. I'm all for saving money but there's certain things that end up costing more in the long run. Cars been one and D.I.Y'ing it when you've not a clue. D.I.Y I'm fine with cars I'm not
 
If its an expensive repair let the garage get the bits, I don't tend to use a garage where possible but the one I use for MOT etc are very honest ( I Think) and they have told me in the past if I buy the part they will gladly fit it but if its wrong I pay more. Some times its not worth the hassle :)
 
Most eBay parts are sh*t quality

It's the cheapest / copy parts they sell to u for a massive markup

Always use a local car parts shop and u order parts and get them to deliver to garage

Less headaches
 
I've always used gsf car parts. They've not been far off the eBay prices.

Vauxhall wanted £1200 for the repair, the parts in shops are £400 and labour from £200 to £400 from the local garages i tried. Cchristmas had just made me skint i had no choice, either way i have legal rights on buying faulty good even off ebay and if the parts are faulty.

I have taken my car to three independent garages asking for their opinion on the noises I am getting, the difficulty of gear selection and the noise coming from it when starting the engine and moving off and all garages informed me it was a dual mass flywheel & clutch problem

The garage does have over 25 years experience and i have never had issues with him as he is a fmaily friend

Any help would be appreciated.

Hi all

Just an update, I decided to put a claim in through PayPal and won, I sent the cheap dmf and clutch kit back.

I contacted trading standards but was informed I have to go through citizens advice. After a helpful conversation I decided to ask if I am entitled to claim back labour charges twice total of £480 and loss of earnings. They told me to write a letter and include a copy of the garage bills and give them 14 days which I am now waiting for a reply.

I then decided to have a look via Google at this company and have found nothing but negative feedback

Yes you can its a lengthy process but dont let that put you off (i didnt and i won against Tmobile the Tossers Grrrrr), the more priors you can dig up the better as your case will be "sale of goods act fit for purpose based" and since they incorrectly advised on the spinner re-fit then they are culpable and must stand any costs incurred.
