Letter to make a chargeback claim - Which? Consumer Rights

How do I use chargeback? - Which? Consumer Rights

Time limit There is a time limit on chargeback claims - typically 120 days - which starts from the day you become aware of a problem. There is also an overall cut off point of 540 days for Visa chargeback. Therefore, your deadline for requesting a chargeback is 120 days from discovering you have a problem, or 540 days from the transaction date, whichever comes first.

Shop/online purchase In the case of tangible goods that you've purchased from a high street shop or an online retailer, the time limit on chargeback would start from the day you receive your items.

Both my plasma and LED went and I had a nightmare with mine. In warranty but only just. Either way you get on, my advice is to use Samsung from now on. Terrible service and sub standard goods in my opinion.

There is quite a difference between buying new and buying brand new on the internet,
The seller you bought from was selling them as new(other) which if you click on it brings the details up:

"New other (see details): A new, unused item with absolutely no signs of wear. The item may be missing its original packaging, or the original packaging has been opened or is no longer sealed. The item may be a factory second, or a new and unused item with minor defects. See the seller’s listing for full details and description of any imperfections. See all condition definitions- opens in a new window or tab".
His last one however was listed as used but still states that they are zero hours, unboxed for testing and in "as new" condition. May have slightly changed his terminology in light of your case.

The other key factor was the price you paid, £400 for a tv that is currently being sold elsewhere at just under £1000 brand new.
The seller also gives 12 months' warranty, did you try and arrange a repair with him before contacting LG?

I hope this gets' sorted in your favour casuk but I don't think its' fair or accurate from what you have posted thus far to say that this seller has ripped you off.
The seller clearly states on ebay that the contact is Sands tv along with the company registration, vat details, etc; He appears to be selling decent products at a very good price and his feedback would suggest that he is doing a good job of it.

Any tv, regardless of brand can go wrong at any given time. I was an independent engineer for over 30 years and have had them all on my bench through the years. A bad experience with an LG set doesn't mean that all their products are bad, it just means you were unlucky.
I am a member of a trade only forum and can see how difficult making a living is in this trade nowadays. Overpriced and often hard to obtain spares, coupled with customers who don't want to pay repair charges and leave you in no doubt that they feel they have been ripped off.

Sorry for the lengthy post casuk but at this moment, with the information you have posted, I personally can't see how you have been ripped off.
