Need advice for a friend? Help

eeeeeeer has he not thought of saying his wife ws driving and the let the insurance take over ??
i am sure if his wife has insur and so does he then he should be covered
just my 2 pence worth
most polices cover drives over 25 anyway tbh

my mate is still waiting for the full facts so not sure what he's going to do until then.

brief info he does have is that the other party have no witnesses, no CCTV evidence.

Also, probably a stupid Q, are uninsured drivers able to get legal aid?

My friend acknowledges he made an innocent mistake and should have read through his policy before procedding to drive another vehicle but hes human and mistakes are going to happen.

At the scene he offered to pay for the damage and did offer to get it fixed from the dealers............

So he did know he was uninsured at the scene?
Thought there was no one at the car at time of accident?

at the scene, he offered to pay for the damage instead of going through the insurance. His opinion at the scene was that the vehicle damage wasnt too bad and better to be done privately. Obviously later on that day he realised that he wasnt insured
 
Legal advice is still top of the list - from an adviser experienced in motoring offences:

i) Would the documents provided by the insurance company cause a 'reasonable person' to presume cover was in place?
ii) Should he retract the admission of liability, given the insurance company (if he was covered) could use it as 'grounds for avoidance'?
iii) Given there are no witnesses and no CCTV is available should his wife admit to driving?

Note: this last is borderline - lying is not an offence, intention to defraud is.

If Mr Plod gets involved:

i) He's looking at probably 6 points, £200 fine and, possibly, a short ban and that's at best
ii) Mr Plod will interview his missus next
iii) If she says the car was taken with her consent she'll be looking at a rap for allowing the car to be driven without insurance (owner's responsibility)
iv) If she says it was taken WITHOUT her consent, he'll be looking at a TWOC rap

Legal Aid is determined by ability to pay, not the offence

He needs legal advice like yesterday.

sorry miggy but he does say he did not know and should of read thought policy
he must have waited for someone to turn up is all i can think
 
What I would do if the other bloke started getting funny and trying to claim extra stuff is accept the six points a small fine from the courts and then the person will have to take you to small claims court to try and get any money out of you

Having an IN10 offence code on his licence would probably see his insurance premium rise to more than that of any whiplash settlement...
