1. You are getting rid of the banned console and getting a new one, but you're keeping your old hard drive.

If you try and connect your old hard drive from the banned console to the new one, your gamertag and saves will show up as corrupt. You can delete the gamertag and recover it via Xbox Live. Some people have said that their saves can be accessed again after doing that, while others have said that they can't, but either way, you can definitely recover your gamertag via Live. If you want to be able to play XBLA games and DLC downloaded on the old console on the new console, you will need to be signed into Live with the gamertag that originally downloaded them, unless you use the license transfer tool.

2. You are getting rid of the banned console and your old hard drive and getting a new console and new hard drive.

Use the recover gamertag option. If you re-download all of your DLC and XBLA games, use the license transfer tool on Microsoft's site or you'll only be able to access the games/content while signed into Live with the gamertag that originally downloaded them. Once you've done a license transfer, you can access games/content with any gamertag on that 360, online or offline.

3. You are keeping the banned console and buying a new console for online use, and you want to share one hard drive between them.

Every time you swap the hard drive from one console to the other (assuming you use the recover gamertag option on the unbanned console), your gamertag and game saves will show as corrupt. As you can't recover your gamertag on the banned box, this can lead to problems!

4. Your flashed console is unbanned, but you've decided to keep it offline from now on. You also buy a new console for online play.

If you do this, you can swap hard drives between the two consoles without any corruption issues, whether you use your old hard drive, a new hard drive, or both. Any XBLA games or DLC downloaded on the new console will not work on the old console when you connect your hard drive to it due to the way licensing works. There is no way around this as you cannot sign into Live to authenticate the content.
