Claiming money from employer

Hi,

Looking for some advice on how to claim outstanding salary from an employer. They owe us salary for May and told us today they are not paying as they are looking to sell the company. I've filed a small claims online and also claimed unfair dismal.
From looking at small claims, even if they find in your favour, they dont seem to have the power to force the person to pay.

Any other tips? Is there a way to file bankruptcy on a person/company?

Yes its LTD company.
 
First of all you dont need to through small claims because its unlawful deduction of wages and should be persude through the employment tribunal. If they go insolvant or bankrupt then you have to claim the amount back through the insolvancy service.... how long have you been there... were you made redundent? Contact your local Citizens advice and find out about lodging a ET1 application.
 
Thanks for the feedback. Its a strange situation. Not been made redundant or laid off. The Director just said he's trying to sell the company and not willing to pay. He reckons the new owners, if he finds one, will have to pay. So decided no point going in again as I'm just working for nothing. He's having a break in India and don't even know if he will be back. I know he has other business and property in the UK and money to pay. Been working there for just under 3 years now.
 
claim unfair dismissaal if u have worked there for 2 years

u have been unfiarly dismissed, redundancy was not formally offered neither was consultation process

fill in ET1 form over the net [view acas website] and claim for unpaid salary plus notice periods for termination of contract and unfair dismissal
 
Go back to work and take goods to the value of your wages.

you should do that but take goods more value than your wages like baliffs do
and use the phones to buy things i remember years ago you could phone a number and order ps2 games and they would take the money from the phone bill there must be some of them companies still around

In that case i would do this.
Have a huge breakfast, a fry up would be a good idea.
Buy a petrol can and fill it up.
Buy one box of matches or clipper lighter.
Buy one sledgehammer.
Buy a bottle of laxatives and go to your old place of work.
Take 2 pills and wait 5min.
Then when pills take effect, pebble dash his windscreen with your smelly offload.
Then take petrol can and empty contents on to the bonnet.
Then with sledgehammer in hand, summon your old boss out to car park.
Ignite one of the matches and make your intent known.
If he refuses to play ball, ignite the bonnet and disprove the theory that shit does not burn.
Finally post an update from whatever jail your in..

Doubt you'd get in trouble, as long as they deducted NI & Tax. They could go to jail for not paying it.
Don't forget you will need a P45 from him for your next employer.
Bloke sounds like he needs a good seeing to.

I received confirmation of my hearing at the Employment tribunal which will be held next month. I just hope he doesn't sell the company before then and remove himself as a Director.

I assume you have had NI and Tax deducted from your pay under the paye scheme ? if so you will not be asked to pay it or be in trouble as you have already had it deducted at source.

the Inland Revenue however will be interested and will take the matter on to retrieve the amounts due, tbh if he hasn't paid for a year then the company is probably on a list somewhere to be investigated.

the Mrs had the same thing some years ago, once the IR had sorted out the company they assured all the employees that their NI contributions were updated.
 
Latest update.....the company has now filed for liquidation.
Think I have no chance now of getting any money back :sad:
 
claim through the government providing you have 2 years service

salutatory redundancy is covered by the government
