hi im hoping for a bit of advice I bought an lg tv in January 2013, 9 weeks ago picture went on it sent it to lg for repair under warranty and they said they replaced motherboard its fixed this it were it goes wrong. got tv back same problem (for a couple mins) so phoned lg again told of problem then tv came on guy on the phone said if happens again let lg know, so 3 weeks ago problem comes back tv down for 3 days they say its out of warranty as tv was made oct 2013 they wanted proof of purchase so sent it then they wanted vat info I told them of the failed repair so they picked it up again no probs got a call today saying that the tv is ber (beyond economic repair) and they are sending it back not sure were I stand on this

If you bought TV in January 2013 and you have a 1 year guarantee then its still under warranty. Your receipt proves that you bought it in January I take it? If it does then take it up with the retailer as your contract is with them not LG. One yr Guarantee means nowt really anyway if the TV is beyond repair now even if they say it was made in OCT 2012 which is 13 months then its not fit for purpose., Dont give up on this, I wouldnt

@Him Her for more advice as he will know about fit for purpose etc

Where are they sending it back to...?

You're still within your 12 months manufacturers warranty (from the date of purchase) so they can't send the TV back to you not working... ring them again and ask them this... "when can I expect delivery of the new replacement TV"

Don't let them fob you off mate... you are well within your rights to demand a new replacement TV if the original one cannot be fixed.

I has a similar sh*tty experience with Dixons/Currys a few years back with a Sony MD player (remember them?). They tried to fob me off with a tatty ex-display unit because Mastercare (AKA Mothercare) were incapable of repairing. I stuck to my guns (made a lot of noise in the shop) & ended up with a much dearer Kenwood unit.

Moral of the story: Buy from John Lewis. Their after-sales is second to none, AND you get 5 yr warranty as standard.

Good luck with yours, name & shame retailer, save someone else the grief.
 
Sending it back to me they said and iv to send tv back to retailer for replacement or refund but it was lg who fixed it first time and they have opened it

First, your contract is with the retailer, date of purchase is relevant, date of manufacture is not your problem. So, you need to slap the retailer first and let them deal with it - they do often try to fob you off with the 'send it back to the manufacturer' BS. Don't, make them deal with it. Because you sent it back to LG should not make a difference (if a local repair guy had opened it that would).

Go back to retailer and create a fuss as publicly as possible (start quiet, get louder lol). Don't be drawn into a 'quiet office' - it's more embarrassing for them in a public space.

As far as legal is concerned, the Sale of Goods Act has a provision, your refund value may be reduced in proportion to the amount of enjoyment you have already had (i.e. it worked for 11 months so you got 11/12, your refund is 1/12 of cost). If you accept this without a fight you're stuffed. Dig your heels in and demand a working TV.

Part of the problem with 'fit for purpose' is that after six months responsibility moves from retailer to buyer in terms of proving the difference between 'inherent fault' and 'misuse'.

Your best bet is to harass the retailer and get everything in writing or take someone as a witness. Record verbal discussions and don't give up.

Don't be diverted by the 'flim flam', quote the Sale of Goods Act, specifically the "repair was unsatisfactory" and responsibility lies with the retailer. You have the option to choose a full refund, repair or replacement. I would stick out for a full refund.
 
So should I accept the tv back from lg then chase the retailer for refund/replacment or keep on at lg for refund/replacment

It's complete madness... the TV is going to end up back with LG anyway... so why not cut out the middle-man (the retailer) and just ask the retailer to deal directly with LG... how many more unnecessary miles does the TV have to travel...?

update> after back and forth phone calls sending paper work, invoices, receipts lg finally give me the BER (beyond economic repair) letter to get a replacement so contacted the company I bought tv from and they are refusing this as the are not a retailer but a repair service. I have also refused return of tv from lg as I don't want a broken tv

What's this mean? you contacted the retailer who you bought the TV from and they have refused to replace the TV stating that they are not a retailer but are a repairer?

Who is the company you bought the TV from, please name them in your next post
 
That's what they are saying either way it was a new tv and its still not repaired
