i know it sounds dumb but can he not put down some 'mitigating circumstances' or something?

surely an unintentional mistake of not being insured when under the impression of being 'insured' cannot be accountable for thousands of ££££!!!! ?.... no one injured

There is little he can do with regards to the accident; the insurers won't touch it unless he finds that he is actually insured. Even then, with the time frame since the accident, it may be at their discretion and would likely only cover the 3rd party.

With regards to the fraudulent personal injury claim, he needs to speak to a solicitor ASAP - hopefully he took legal cover when he got the car insurance. If not he'll have to check other insurance policies (house, life) and any professional or union memberships.

Also I'd advise he makes sure that any property is owned by both him and his wife equally, i.e. rather than each having a 100% stake they both own 50%, and that he talks to a bankruptcy specialist should the worst happen.
 
The guy could have easily driven off as the BMW was empty...


Oh well, that was nice of him not to drive off after damaging someones car while driving uninsured.

I am sure that once he explains that he could have simply driven off, but didn't, the other chaps insurance will be more than happy pay for the damage.

You seem to be deliberatly missing the point that he didn't know he was uninsured at the time.
 
May I point out this man was insured his wife was insured there was just a misunderstanding as to whether he was able to drive any car or not it was explained in a previous post. We can all learn a lesson from this, check your policy read it, understand it and most of all play by the rules or face the consequences.
 
Not wanting to be pedantic, you either know if you are insured to drive other vehicles or choose not to know.

Not necessarily Do insurance companies ask you if you need/want to drive someone else's car?. I know lots of people who just pay there premium get the policy and then throw it in a draw until the next year.Long drawn out policies can be a bore to read especially when it can be 5 pages long.
 
Have to be honest I always fully read my policy when it arrives,it doesnt take long for something that important

But having said that I thought all policy's had it as standard
 
Surely when you pay for your insurance policy you know if you are covered to drive another vehicle etc, not to know and then to drive is lunacy.
You cant tell me you don't know if you are covered to drive other peoples vehicles in all honesty can you?
If you can't you need to check then is the answer.
I am not trying to start any arguements here as i feel the chap may get taken to the cleaners, but we all know what we are covered to drive.
 
I have asked to be a named driver on my wife's policy and she is the named driver on mine it doesn't come as standard mate, and that is probably where it went pear shaped for these people.

But thats named driver,we are talking about your policy covering you to drive other cars,

You said letters recieved were in his wifes name, have you ascertained that the guy was insured to drive this car as it possiblt his wifes.Also on some policys the named owner on log book has to be the policy holder

Sorry wiz I used to be a car mechanic so my policy covers me for anyone's car. I really do hope things work out for this guy but in all fairness its not looking good. Without witnesses/camera's as stated in a previous post he can't possibly beat them and this 3rd party guy knows this. If this couple have not got a shared/named policy then there is nothing they can do.
